FANTV PRIVACY POLICY

We, ArtistFirst Technology FZE (“we”, “our”, “us”, or “FanTV”), are committed to protect the privacy of the users of FanTV (“you”, “your”, or “User”) and therefore, seek to follow the highest standards to secure and protect the information shared by you with us. This Privacy Policy describes the manner of collection, storage, use and sharing of personal information that is collected by FanTV from the Users and the choices and controls available to the Users regarding the information provided to us when you avail the services of FanTV for the purpose of hosting, listening, viewing, publishing, transacting, displaying, or uploading content, information or views, through our products, features, technologies, software, and related services provided to you from our platforms, applications, websites, or through any other mode or media (collectively, the “Service”). This Privacy Policy is to be read in conjunction with the FanTV Terms of Use. All defined terms that have not been specifically defined herein shall have the same meaning as provided under the FanTV Terms of Use.

1. CONSENT TO THE PRIVACY POLICY By using the Service and/or by clicking “I agree”, you agree to provide consent to our collection, use and sharing of your personal information as described in this Privacy Policy.

2. INFORMATION COLLECTED BY FANTV In order to provide the Service, FanTV collects data via information provided to us by the Users, information collected while browsing or navigating through the Service, information inferred through usage and log data, and information collected from third parties.

a. Information provided to us by the User. FanTV collects content, communications, and other information provided by the Users while using the Service, including while creating an account without which FanTV will not be able to provide the Service. The following personal information about the user may be collected when the User creates an account:

3. Name of the User
4. Date of birth of the User
5. Address and Country of the User
6. Information from third parties – the User may choose to share certain data with FanTV from third parties if the User chooses to register with FanTV using a third-party service such as Google. The User may provide additional information for the user profile such as a photograph, and optional additional personal data in order to further personalize the user profile.

b. Information collected during the use of the Service:

FanTV collects information about how you use our Service such as the types of content that you view or engage with, the features you use, the actions you take, the accounts you interact with, the time, frequency, and duration of your activities. Further, when the User uses our Service, FanTV may also collect information relating to the User’s device such as: Device attributes such as the operating system of the device, the make and model of the device and the browser type. IP address, connection and speed of the internet, time zone, device signals such as Bluetooth signals, information of nearby Wi-Fi access points. Information which you allow us to retrieve through permissions, such as GPS location, camera, microphone, photos. Cookies – The Service uses cookies and other similar technologies which are necessary to its functioning and to provide the Service. Some of these cookies are essential to FanTV in order to provide you with the Service. Information provided by the User while creating content:

1. FanTV may collect and store all the content posted by you on the Service, including but not limited to videos, photographs, sound recordings, musical works embodied therein, comments, and texts.

2. FanTV may collect any personal correspondences such as emails or letters sent by the Users, and any emails or letters sent by third parties/other users regarding your activity or posts.

3. FanTV may collect information, including but not limited to, when you provide feedback(s), modify your content or email preferences, participate in contests, respond to surveys, provide comments, submit forms, or communicate with us. This information may include your name, e-mail id, mobile number, location, etc.

4. LEGAL BASIS FOR COLLECTING INFORMATION In accordance with the prevailing laws, FanTV will only collect and process personal data about you where we have lawful basis, in a fair and transparent manner. Lawful basis on which we would process our personal information includes obtaining explicit "consent" from you for processing your personal information, processing for "legitimate interests" where processing is necessary by us to provide you with customer support and for processing for "performance of the contract" wherein processing is essential in enabling our Service to the users. We may also process your information for "legal requirements" and in order to comply with applicable laws and to co-ordinate with law enforcement agencies.

The information collected from you is used by us to develop and improve the Service and also to provide you a personalised experience while using the Service. We use information to provide, analyse, administer, enhance, and personalize our service and marketing efforts, to process your registration, to provide you services, and to communicate with you related to below mentioned points. FanTV may collect information for statistical analysis, i.e., to analyse and understand our audience, improve our service (including our user interface experiences), recommendation algorithms and delivery.

4. HOW DO WE USE YOUR INFORMATION The Information as supplied by the Users enables us to improve the Service and provide you the most user-friendly experience. All required information is service dependent, and FanTV may use the above said user Information to, maintain, protect, and improve the Service (including advertising on the Service) and for developing new services. We may also use your email address or other personally identifiable information to send commercial or marketing messages with your consent [with an option to subscribe/unsubscribe (where feasible)]. We may, however, use your email address without further consent for non-marketing or administrative purposes such as notifying you of major changes, for customer service purposes, billing, notifying you in case of breach incidents, etc.

Any personally identifiable information provided by you will not be considered as sensitive if it is freely available and/or accessible in the public domain like any comments, messages, blogs, scribbles available on social media platforms like Facebook, Twitter etc. Any content posted/uploaded/conveyed/communicated by users on the public sections of the Service becomes published content and is not considered personally identifiable information subject to this Privacy Policy. In case you choose to decline to submit personally identifiable information on the Service, we may not be able to provide certain services to you. We will make reasonable efforts to notify you of the same at the time of opening your account. In any case, we will not be liable and or responsible for the denial of certain services to you for lack of you providing the necessary personal information.

When you register with the Service, we contact you from time to time about updating of your personal information to provide the users such features that we believe may benefit/interest you.

5. HOW IS YOUR INFORMATION SHARED a. FanTV does not share your information with any third party without obtaining prior consent, with the exception of the following limited circumstance: b. FanTV may provide personal information when it is requested or required by law or by any court of law or government to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for complying with the applicable laws and regulations. c. FanTV may provide personal information to our affiliates and other trusted businesses or persons such as service providers to help us with customer support, payment processing, data analytics, technical support, marketing support, or support for securing our systems. The information will be based on in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. d. FanTV may share aggregated statistical data with our partners, sponsors, and suppliers about how our users are interacting with our Service and availing of the features offered. e. FanTV may provide sponsors with reports containing aggregate statistical data about how our Users are interacting with our Service and to determine the kinds of people viewing their ads and how they are performing. This aggregated information may include demographic data such as age range and/or geographic location of groups of our customers. This aggregated data does not include contact details (such as names, addresses or email addresses) that can be used to personally identify you or contact you. f. FanTV may share your personal information in order to enforce applicable Terms of Use of the Service, including investigation of potential violations, to detect, prevent, or otherwise address fraud, security, or technical issues, to comply with any applicable law, legal obligation, to protect the rights, property, safety, or security of third parties, comply with a court order, or request from governmental authority or law enforcement agencies.

Public information on the Service can be seen by any person, including if they do not have an account. This includes the username, any published content on the profile, profile picture, if any, number of followers. Public information can also be seen, accessed, reshared or downloaded through third-party services such as search engines, APIs, and offline media such as TV, and by apps, websites and other services that integrate with our Service.

6. RETENTION OF INFORMATION FanTV retains the information collected information for as long as required in order to provide the Service. Personal data collected shall be retained as long as your account is maintained, and till the time our Service is used and accessed by you. The information will be deleted on a request from the User or at the deletion of the account. However, after the account is deleted or the User has requested for the information to be deleted, FanTV may archive and/or retain some essential information for legal purposes.

MANAGING THE INFORMATION AND EXERCISING YOUR RIGHTS When you use the Service, we make good faith efforts to provide you, as and when requested by you, with access to your personal information and shall further ensure that any personal information or sensitive personal data or information found to be inaccurate or deficient shall be corrected or amended as feasible. We ask individual Users to identify themselves and the information requested to be accessed or corrected before processing such requests. We may decline to process requests that are unreasonably repetitive or systematic, requiring disproportionate technical effort, jeopardizing the privacy of others, or would be extremely impractical, or for which access is not otherwise required. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

8. KEEPING PERSONAL DATA SAFE FanTV takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of your information. These include appropriate technical and organisational measures including but not limited to internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data.

All information gathered on the Service is securely stored within our controlled database. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, please note that we cannot assure 100% safety of any information and therefore, users must exercise discretion in sharing their information. If you know or have reason to believe that your Service account credentials have been lost, stolen, altered, or otherwise compromised or in case of any actual or suspected unauthorized use of your account, please contact us by contacting our customer support team.

It is the User’s responsibility to only allow individuals to use your account where you're comfortable sharing this personal data with them.

9. CHILDREN’S PRIVACY POLICY The Service is not aimed or targeted towards children under the age of 18. We do not intend to or target to collect any information about children under the age of 18. Children below the age of 18 must access or use Service only with the approval of and under the supervision of their parent or legal guardian.

FanTV considers it the responsibility of parents to monitor their children’s use of our Services. Nevertheless, it is our policy not to collect and process any personal information from children below 18 years of age or offer to send any promotional materials to persons in that category. We do not seek or intend to seek or receive any personal information from children. Should a parent or guardian have reasons to believe that a minor has provided us with personal information without their prior consent, please contact our customer support team to ensure that the personal information is removed from the Service.

10. CHANGES TO THIS POLICY This Privacy Policy is subject to change from time to time. We reserve the right, at our sole discretion, to modify the terms of this Privacy Policy from time to time in order to ensure compliance with applicable laws. The updated privacy policy shall be effective immediately and shall supersede these the terms of this Privacy Policy.

We are not under an obligation to notify you of any changes to this Privacy Policy except if the changes made to the policy significantly affects your rights or as may be required by law.
